HUD permits use of 2010 ADA Standard   

  

On May 23, 2014, the U.S. Department of Housing and Urban Development announced that it will now permit the use of the 2010 ADA Standard for federally funded programs and projects that are subject to Section 504 of the Rehabilitation Act of 1973, and its subsequent implementing regulations and revisions. On and after May 23, 2014, HUD permits the use of the 2010 ADA Standard for design of new construction or alteration of federally funded dwelling units. When using this standard, it is important to note that HUD has placed several restrictions, especially for sites with structurally impracticable conditions or terrain. HUD also did not adopt the use of several 2010 ADA Standard provisions for employee work areas http://portal.hud.gov/hudportal/HUD?src=/press/press_releases_media_advisories/2014/HUDNo_14-057 . This will remain in effect until HUD formally revises its Section 504 regulation to adopt and update an accessibility standard.

This means designers and builders have one common design standard (with some exceptions) for new construction and alterations of federally funded or assisted housing, and their related facilities. Designers will no longer need to second guess or to blend the Uniform Federal Accessibility Standard (UFAS) with the 2010 ADA Standard and subsequently the California Building Code.

As a reminder, the California Building Standards Commission revised the 2013 California Building Code Chapter 11B for public accommodation and publicly funded facilities in order to meet or exceed the 2010 ADA Standard. The CA Department of Housing and Community Development (HCD) has worked diligently to keep pace with the federal accessibility regulations. There are some technical provisions in Chapter 11A that exceed federal requirements for adaptable dwelling units, multi-story dwelling units, additions and alterations. Also HCD is processing a 2013 Intervening Code update to 2013 CBC Chapter 11A
